Virginia Spousal Support Calculator & Guidelines
Virginia spousal support—often called alimony—is not determined by one universal calculator. Virginia does provide a presumptive formula for certain temporary (pendente lite) cases, but a final support award depends on the facts of the marriage and the statutory factors a court must consider.
This guide explains the temporary formula, final-award factors, duration, modification, and termination rules for divorces in Virginia Beach and throughout Hampton Roads. It is general information, not a prediction of any particular case.
Virginia temporary spousal-support calculator
Virginia Code § 16.1-278.17:1 creates a presumptive formula for pendente lite spousal support in proceedings under Title 16.1 when the spouses’ combined monthly gross income does not exceed $10,000.
Spouses with minor children in common: 26% of the payor’s monthly gross income minus 58% of the payee’s monthly gross income.
Spouses without minor children in common: 27% of the payor’s monthly gross income minus 50% of the payee’s monthly gross income.
Example: If the payor earns $8,000 gross per month and the payee earns $2,000, their combined income is $10,000. The formula produces an estimated $920 per month when they have minor children in common, or $1,160 per month when they do not.
The court may deviate for good cause based on the parties’ current financial circumstances and applicable tax effects. “Gross income” is defined consistently with Virginia’s child-support statute. This calculation concerns temporary support; it does not determine the final award.
Temporary support versus final support
Temporary support may be ordered while a divorce is pending. It is intended to address current needs before the court resolves the entire case. A final award is governed primarily by Virginia Code § 20-107.1, not by the temporary formula.
For final support, a court may award periodic payments for a defined or undefined duration, a lump sum, or a combination. The court may also reserve a spouse’s right to seek support later. The result can differ substantially from a pendente lite estimate.
What factors determine final spousal support in Virginia?
Under § 20-107.1, the court considers the circumstances contributing to the dissolution of the marriage and factors that include:
Each spouse’s obligations, needs, income, retirement benefits, and other financial resources;
The marital standard of living and duration of the marriage;
Each spouse’s age and physical and mental condition;
Monetary and nonmonetary contributions to the family;
Real estate, personal property, debts, and the equitable-distribution award;
Earning capacity, education, training, work history, and available employment;
Career and parenting decisions made during the marriage and their effect on earning potential;
Contributions one spouse made to the other’s education or career; and
Tax consequences, fault, and any other factor needed to reach an equitable result.
In a contested circuit-court case, an order granting, reserving, or denying support must include written findings identifying the factors supporting the decision.
Does adultery bar spousal support?
Adultery can be a statutory bar to permanent support when the other spouse has established that ground for divorce. However, the court may still award support upon clear and convincing evidence that denying it would create a manifest injustice, considering the parties’ relative fault and economic circumstances. The pleading, proof, defenses, and financial record matter.
How long does spousal support last?
Virginia does not impose a simple rule that support lasts a fixed percentage of every marriage. A court can order support for a defined duration, for an undefined duration, as a lump sum, or in combination. If the right to seek future support is reserved, § 20-107.1 creates a rebuttable presumption that the reservation lasts for 50% of the time between marriage and separation, subject to the statute and the terms of any agreement or order.
Can Virginia spousal support be modified?
Under Virginia Code § 20-109, a court may increase, decrease, or terminate support when the legal requirements are satisfied. Defined-duration awards have additional conditions. A separation agreement may restrict modification, so the exact language of the agreement and decree must be reviewed. Reaching full retirement age is a material change in circumstances, but it does not automatically end support.
When does spousal support terminate?
Unless a valid agreement provides otherwise, Virginia spousal support terminates upon the death of either party or the recipient’s remarriage. A court also generally must terminate support when clear and convincing evidence shows the recipient has habitually cohabited with another person in a relationship analogous to marriage for at least one year, unless an agreement controls or the recipient proves termination would be unconscionable.
Documents that can affect a support analysis
Recent pay stubs, tax returns, W-2s, 1099s, and business-income records;
Military LES documents, allowances, bonuses, and retirement information;
Bank, investment, pension, and retirement statements;
A realistic monthly income-and-expense statement;
Health-insurance and medical-cost records;
Evidence of childcare costs and parenting responsibilities; and
The separation agreement, prior orders, and evidence relevant to fault.
Why an online estimate is only a starting point
The statutory temporary formula has an income ceiling, permits deviation, and does not control final support. Disputes over gross income, self-employment, voluntary underemployment, military compensation, marital fault, property division, and contractual language can materially change the analysis.
